Terms and Conditions

These Terms and Conditions (“Terms”) govern your (“you”, “user”, “Customer”) use of services (“Services”) provided by Capital Small Finance Private Limited (“Capital Small Finance”, “we”, “us”, or “our”) via our web-based application platform (“Platform”).

By accessing or using the Platform and Services, you agree to these Terms, which form a binding agreement between you and Capital Small Finance. If you do not agree, please refrain from using the Platform.

Please also read our Privacy Policy which forms part of your agreement with us.

1. Electronic Records

These Terms are an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signatures.

2. Overview of Our Services

a) Service Offerings

Capital Small Finance is a fintech platform facilitating access to:

Credit Facilities
Insurance products
Mutual funds
Digital gold
Bharat Bill Payment Services (BBPS)
Job portals
Credit reports
Reward programs

These are offered through partnerships with financial and service providers (“Partners”).

b) Lending Services

We do not provide loans ourselves.
Loans are offered by RBI-registered NBFCs and banks (“Lending Partners”).
Capital Small Finance facilitates loan application, EMI collections, and communications on behalf of the Lending Partners.
The decision to approve or deny a loan lies solely with the Lending Partner.

3. User Eligibility

You must be 18 years or older, an Indian national, and legally competent to enter into a contract.
You must create an account (“Profile”) and keep your credentials confidential.
You are responsible for all activity on your Profile.

4. License and Access

We grant you a limited, non-transferable, revocable license to use the Platform.
You must not modify, reverse-engineer, copy, reproduce, resell, or misuse the Platform or any content therein.
Unauthorized use will result in termination and potential legal action.

5. Prohibited Uses

You agree not to:

Use the Platform for illegal activities.
Violate intellectual property rights.
Spread malware, spam, or misinformation.
Harass or discriminate.
Collect personal data without consent.
Violation may result in suspension or termination of your access.

6. Communication

By using the Platform, you agree to receive communications via SMS, email, WhatsApp, phone calls (manual or automated), etc., related to:

Transactions
Repayment reminders
Promotional offers
Service notifications

7. KYC (Know Your Customer)

KYC completion is mandatory for accessing certain services, especially lending.
You must provide valid, truthful documents and consent to us collecting and processing this data.
Failure to do so may lead to denial of services or account termination.

8. Credit Facility

Clicking ‘I Accept’ on the loan agreement binds you to the loan terms set by the Lending Partner.
You are responsible for all repayments under the agreed schedule.
Breach may lead to immediate recovery actions.

9. Products and Reward Programs

Services include:

Insurance
Mutual fund access
BBPS bill payments
Digital gold
Credit bureau reports
Rewards programs
Job listings

Capital Small Finance is not liable for the performance or delivery of services/products by third-party Partners.

10. Modification of Services

We may change, suspend, or discontinue services at any time without prior notice.
You may not delete your Profile while repayment obligations or service use is ongoing.

11. Third-Party Services

The Platform may include links or content from third-party services.
We are not responsible for the accuracy, security, or legality of third-party content.
You use such services at your own risk and are bound by the terms of those providers.

12. Indemnification

You agree to indemnify and hold Capital Small Finance harmless against all claims, losses, or damages arising from:

Breach of law or these Terms
Misuse of the Platform
Providing false information
Infringement of third-party rights

13. Limitation of Liability

We provide services “as is” with no warranties.
Capital Small Finance is not liable for indirect, incidental, or consequential damages.
Users outside India use the Platform at their own risk, and Indian laws will apply exclusively.

14. Termination

We may suspend or terminate your account or access without prior notice for violations of these Terms.
Upon termination, your right to use the Platform ends immediately.

15. Force Majeure

We are not liable for failure to perform due to causes beyond our control (natural disasters, strikes, internet outages, etc.). However, repayment obligations remain unaffected.

16. Takedown Policy

To report objectionable content:

Email the Grievance Officer (details in Privacy Policy)
Include your contact info, the objectionable content, and the reason for the complaint.
We’ll evaluate and take appropriate action.

17. Governing Law & Jurisdiction

These Terms are governed by Indian law, and all disputes shall be subject to courts in Delhi, India.

18. NACH Mandate

A NACH (electronic debit) mandate may be required for loan repayment.
Cancellation requests must be sent to our support address.
If canceled before full repayment, you must provide an alternate payment method.

19. Platform Fee Policy

We may charge a fee for certain non-lending services.
These charges are non-refundable once the service is accessed.

20. Miscellaneous

Notices: Sent to our registered address.
Assignment: You may not transfer your rights. We may.
Severability: If one provision is invalid, others remain effective.
No Waiver: Our delay in enforcing rights does not waive them.
Monitoring: We may monitor activity and content to ensure compliance.
